Terms of Service

These terms govern your use of Eturnal Rest, a service of Data Jockey LLC ("we", "us"). By using the service or submitting a listing, you agree to them.

1.What we do

Eturnal Rest is a marketplace that connects people who want to buy burial spaces with people and cemeteries who have spaces to sell. We advertise plots, crypts, and niches, and we help buyers and sellers find each other. We are not a broker, and we do not take a cut of any sale.

2.Fees and billing

  • Sellers pay a recurring advertising plan to advertise their spaces on the marketplace, billed once a year. The rate is based on how many plots you advertise, starts at $49 a year for a single plot, and the price per plot decreases as you advertise more.
  • Your plan renews automatically at the end of each yearly billing period until you cancel. You can cancel at any time, and your listings stay live through the end of the period you have already paid for.
  • We do not charge a commission, and we do not take any percentage of your sale. What you sell your space for is between you and your buyer.
  • Cemeteries and other organizations that advertise spaces in bulk pay the same graduated per-plot rates. Bulk upload and concierge setup are included at no extra charge. Questions are welcome at info@eturnalrest.com.

3.Your responsibilities

  • You confirm that you have the legal right to sell the space you advertise.
  • You agree to provide accurate information about the space.
  • You are responsible for any transfer paperwork or cemetery rules that apply to your space.

4.No guarantee of sale

We do not guarantee that a space will sell, or sell at any particular price or time. Any estimates we provide are informational, not offers.

5.Text messaging

If you opt in to text messages, our SMS terms and the Privacy Policy apply. Reply STOP to opt out, HELP for help. Consent is not a condition of using the service.

6.Limitation of liability

The service is provided "as is." To the fullest extent allowed by law, Data Jockey LLC is not liable for indirect, incidental, or consequential damages arising from your use of the service.

7.Governing law

These terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law rules.

8.Changes

We may update these terms. Continued use after a change means you accept the updated terms.
